Acceptance of Terms

By accessing or using Torqlytics (the "Service"), operated at torqlytics.com and app.torqlytics.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Torqlytics ("we", "our", "us"). Please read them carefully.

Account Registration

To access certain features of the Service, you must create an account. When registering, you agree to:

Provide accurate, current, and complete information.
Maintain the security of your password and accept responsibility for all activity under your account.
Notify us immediately at [email protected] if you suspect unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

Subscriptions & Pricing

The Service offers the following tiers:

Free -- access to basic analytics features including season overview, driver profiles, standings, basic session analysis, circuit maps, and season awards. Available indefinitely at no cost.
Pro -- access to all features including advanced telemetry overlays, driver comparison, strategy simulator, data export, cross-season comparison, and priority data refresh. Billed monthly at the price displayed on our pricing page.

Every new account receives a 14-day free trial of the Pro tier. No credit card is required for the trial. At the end of the trial period, your account automatically reverts to the Free tier unless you choose to subscribe.

We reserve the right to modify pricing with 30 days' notice to active subscribers. Price changes will take effect at the start of the next billing cycle.

Billing & Cancellation

All payments are processed by our merchant of record, Lemon Squeezy. By subscribing to a paid plan, you authorize Lemon Squeezy to charge your chosen payment method on a recurring basis.

Billing cycle: Pro subscriptions are billed monthly from the date of subscription.
Cancellation: You may cancel your subscription at any time from your account settings. Upon cancellation, you retain Pro access until the end of the current billing period. No refunds are issued for partial billing periods.
Failed payments: If a payment fails, we will attempt to charge your payment method up to 3 times. If all attempts fail, your account will revert to the Free tier.

Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
Attempt to gain unauthorized access to any part of the Service, other accounts, or our systems.
Scrape, crawl, or use automated tools to extract data from the Service beyond normal usage patterns.
Interfere with or disrupt the integrity or performance of the Service.
Resell, redistribute, or sublicense access to the Service without our written permission.
Impersonate any person or entity, or misrepresent your affiliation with a person or entity.

Intellectual Property

The Service, including its design, code, logos, and documentation, is owned by Torqlytics and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written consent.

The "Torqlytics" name and logo are our trademarks. You may not use them without prior written permission.

Data Disclaimer

Torqlytics is not affiliated with, endorsed by, or connected to Formula 1, the Federation Internationale de l'Automobile (FIA), Formula One Management (FOM), or any Formula 1 team.

Race data displayed in the Service is sourced from publicly available third-party APIs (OpenF1, Jolpica F1 API). While we strive for accuracy, we do not guarantee the completeness or correctness of this data. The Service is intended for informational and entertainment purposes only.

Formula 1, F1, and related marks are trademarks of Formula One Licensing BV. All team names, driver names, and related imagery are property of their respective owners.

Service Availability

We aim to provide reliable access to the Service, but we do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

Free tier accounts do not include any service level guarantees. Pro subscribers can expect reasonable uptime, and we will communicate any scheduled maintenance in advance when possible.

Limitation of Liability

To the maximum extent permitted by law, Torqlytics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.

Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any data provided through the Service is accurate or complete.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

You may delete your account at any time through your account settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

Changes to Terms

We may revise these Terms at any time. Material changes will be communicated by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may also notify you by email.

Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in a mutually agreed jurisdiction.
